What holds my argument was that in a scripted duel it was used in the same way, without banishment. We know that the anime effect is not always used in scripted duels, but in one case it was used exactly as it should be.

You are comparing two different situation
Longphone Bull anime even without proxy had a clear indication that it search something different from the ocg (and I'm planning to "fix" the trigger to special summon only when I manage to find some time to do it), also it was first used in the anime then released in ocg

DMOC in the anime was never clearly showed/hinted hitting the GY
In addition, the anime use the ocg effect for card released in the OCG then showed in anime
DMOC was release date is 2003-07-17 (Invader of Darkness), while the episode aired in the episode aired the February 2, 2005 so more or less a year and a half after its release so the chance of the DMOC being different from the ocg is basically null
and if the card is the same as the ocg there is no point in keeping it
